Due process has never been a speedy proposition. Due to the Coronavirus, Florida courts have become even harder to achieve speedy resolutions.
Case in point
Just recently I had a hearing to determine when my client’s divorce can proceed to trial. I waited all afternoon to speak to the judge. Finally at 5:30 p.m., I received an email from the trial coordinator for the judge who simply stated that due to the tremendous amount of cases on the docket, my case would not even be heard today and that it was being continued for two months for another hearing to determine when the case could proceed to trial.
In the blink of an eye, the divorce case that is causing all parties uncertainty and mounting legal expenses just got longer and more expensive.
There must be a solution to this maddening problem. Thankfully, there is: mediation.
What is Mediation?
Mediation is the process of bringing adversarial parties together to resolve their legal differences and to reduce the solution to a written document.
Of course, the parties are free to disagree, but nothing in this world is truly free. The cost of not coming to a reasonable settlement is not only financial. The cost is emotional as well.
The legal system encourages mediated settlement agreements. Not only do you have ownership over the agreement, but you are more likely to accept the solution to your problem because you helped solve the problem.
My role, as your attorney, is to advise you and to help provide you with invaluable insight into your legal problem. In order to properly perform this task, I prepare for your mediation. I review your situation and help you to come up with solutions to your problem.
If mediation fails, then you can always take a number and wait your turn in line for your day in court. There are some legal problems that mediation can not solve. However, it has been my experience that every case has a solution and sometimes we just have to think outside of the box to come up with one.
Together, we can come up with legal solutions that make sense for your family. Part of the reward for coming up with solutions is that you can bypass the long line of cases to be heard by the judge and move to the front of the line to get your legal dispute over with.
